Terminology

The following terminology applies to these Terms and Conditions and any other agreements: “Subscriber”, “You” and “Your” refers to you, the person accessing this website and accepting the Company’s terms and conditions. “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to our Company, Richard J. Holdings, LLC. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves. "Our Website" refers to moderntext.com, modtxt.com, moderntxt.com or any domain owned by Richard J. Holdings, LLC that serves the moderntext software.

Privacy Policy Agreement

You have read and agree to our privacy policy.

Limited Liability

We are not liable for damages resulting from any form of use of our website. This includes but is not limited to following:

  • The content on our website. Including, but not limited to:
    • The information you post and view.
    • The external websites you visit from links published on our website.
  • The availability or technical stability of our website, its functionality and data (including data you may have generated or stored.)
  • Any security issues or breeches.

You are responsible for the information you post. If you post anything illegal or that you do not have the right to post, you will be held liable.

Intellectual Property

By submitting any of your intellectual property to our website, you are giving us the right to store and publish that information until you request for it to be removed, at which point it will be removed within a reasonable amount of time. No consent or waiver, express or implied, to or of any breach or default in the performance of any obligation under this Agreement shall constitute a consent or waiver to or of any other breach or default in the performance of the same or any other obligation.

Severability

Any provisions of this Agreement which are prohibited or unenforceable shall be ineffective to the extent of such prohibition or unenforceability without invalidating the remaining provisions hereof, rendering the remainder of the terms of use in force.

Governing Law

This Agreement shall be construed in accordance with the laws of the State of Connecticut and the obligations, rights and remedies of the parties hereunder shall be determined in accordance with such laws.
